Design Control Application Process (summary)

The Design Review Board (DRB) will only accept applications from Members or from formally appointed representatives of the Member. This being a signed Agreement between the Member and the Representative

A Member can make an application only for the property that they own and not on behalf of others unless formally appointed to do so.

Design Process (Overview)

Once submitted and received by the DRB an acknowledgement of receipt of Application to be provided to the Member.

The Application is to be assigned a unique number for the DRB records, and the application entered into the Design Control application register.

The DRB is to consider the Member’s application in conjunction with the Design Controls laid out in this document.

Once the DRB has made their decision, the Member is to be notified in writing of the outcome

The DRB must advise the decision of the DRB to the KPRA Manager as a matter of record.

Design Register

The Principal Member will keep a record of the Design Control Applications until such time as the Development has been completed.

At an agreed point following the completion of the Development, the Principal Member is to hand over all records, registers, copies of applications to KPRAI.

At no time are any records of any applications to be removed for destruction without the consent of the KPRAI Committee.
Communication to Members

How the Design Controls are communicated to Members and incoming Members (new buyers), is integral to the smooth running of the Design Controls.

This part of the Design Controls is a ‘living document’ and will be updated from time to time by the Design Control Review Panel and / or the Kensington Park Residents Association Committee.
Communication to include:

A Design Control quick guide covering decks, landscape, permanent modifications, temporary modifications and Window Treatments as well as all aspects of the Design Controls.

A summary Flow Chart for the Design Control approval process.
Real Estate Agents

Members using approved external Real Estate Agents are required to comply with the requirements of this document.

Southpark Property Ltd REINZ Park Realty to provide to buyers and deliver the guidelines at an agreed point in the transaction.
Management of Design Controls

All applications for any item contained within this document must comply with sections 1.5 and 7.0 in this document

Non-compliance of these Design Controls will be referred to KPRAI and compliance will be undertaken following By-Law Rule 12.

Regular Park wide reviews are to be undertaken by the Manager to report any breaches of the Bylaws . REF-SEE 12 & 13
